HEALTH AND SAFETY

Sexual Harassment Policy:  This policy applies to interactions between Ark staff, parents and guardians. Sexual-related harassment in the workplace is a form of sexual discrimination barred under the employment protection provisions of the Civil Rights Act. The Equal Employment Opportunity Commission (EEOC) has issued guidelines to encourage employers to inform, affirmatively and convincingly, their employees that sexual harassment is illegal and complaints dealing with sexual harassment may be resolved through the grievance procedure. “Sexual Harassment” is defined as any conduct of a sexual nature, whether explicitly or implicitly. The three criteria that may be used to determine if an action constitutes unlawful behavior are the following:

  1. Submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment or working relationship with the Ark;
  2. Submission to or rejection of such conduct by an individual is used as a basis for employment decisions affecting such individual; or
  3. Such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment.
